Terms of Service

1. Acceptance of Terms

By accessing or using Kilko Studios ("the Platform"), operated by Horane Technologies LLC ("we," "us," or "the Company"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these terms, please do not use the Platform. These Terms constitute a legally binding agreement between you and Horane Technologies LLC.

2. Eligibility

Kilko Studios is available only to individuals who are at least 18 years of age. By creating an account, you represent and warrant that you are at least 18 years old. We reserve the right to verify your age and terminate accounts that do not meet this requirement. The Platform is currently in a closed beta and access is by invitation only.

3. Description of Service

Kilko Studios is a creator economy platform that provides live streaming, creator battles, league competitions, virtual gifting, brand partnership opportunities, agency services, and community features. We reserve the right to modify, suspend, or discontinue any part of the service at any time with reasonable notice.

4. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must provide accurate and complete information when creating an account. You agree to notify us immediately of any unauthorized use of your account.

5. Virtual Coins & Purchases

Kilko Studios offers virtual coins ("Coins") that can be purchased with real currency via credit card, debit card, or other accepted payment methods. By purchasing Coins, you agree to the following:

  • No Cash Value: Coins are virtual credits for use exclusively within the Kilko Studios platform. Coins have no cash value outside the Platform and cannot be exchanged for legal tender, redeemed, or refunded except as described in our Refund Policy.
  • Non-Transferable: Coins cannot be transferred between users outside of the Platform's gifting features. Any attempt to sell, trade, or transfer Coins outside the Platform is prohibited.
  • Pricing: Coin prices are displayed at the time of purchase. All purchases are in U.S. Dollars (USD) unless otherwise indicated. Applicable taxes will be added at checkout.
  • Payment Processing: All payment transactions are processed by our third-party payment processor (Stripe). We do not store your full credit card number. Payment processing is subject to Stripe's terms of service.
  • License: When you purchase Coins, you receive a limited, non-exclusive, revocable, non-transferable license to use those Coins within the Platform as intended.

6. Creator Earnings & Payouts

Creators may earn revenue through the Platform's gifting and economy system. Earnings are subject to the following:

  • A platform fee (currently 35%) is deducted from gross gift value.
  • Earnings are held for a maturation period before becoming available for payout.
  • Minimum payout thresholds apply as configured by the platform.
  • Horane Technologies LLC reserves the right to adjust fee rates, hold periods, and payout thresholds with notice to creators.
  • Payouts are processed to the payment method on file and are subject to identity verification and tax reporting requirements.

7. Refund Policy

All Coin purchases are generally final. Refunds may be issued at our sole discretion in the following cases:

  • Unauthorized transactions reported within 48 hours
  • Technical errors resulting in duplicate charges
  • Coins not credited to your account due to a system error

Gifted Coins that have been received by another user cannot be refunded. To request a refund, contact support@kilko.local within 48 hours of the transaction.

8. Content Guidelines

Users must not post content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable. Kilko Studios reserves the right to remove any content that violates these guidelines and to suspend or terminate accounts of repeat offenders.

9. League Participation

Participation in Kilko Studios leagues is subject to approval. League rankings and match results are determined by Kilko Studios staff and are final. Any attempts to manipulate results will result in immediate removal from the platform and forfeiture of any pending earnings.

10. Brand Partnerships

Brand partnerships facilitated through Kilko Studios are subject to separate agreements between creators and brands. Kilko Studios facilitates connections but is not responsible for the terms of individual partnership agreements.

11. Ambassador Program

Ambassador commissions are paid according to the program terms. Horane Technologies LLC reserves the right to modify commission rates or program terms with notice. Fraudulent referrals will result in immediate termination and forfeiture of earnings.

12. Intellectual Property

The Kilko Studios brand, logo, and platform design are protected by intellectual property laws. Users retain ownership of their original content but grant Horane Technologies LLC a worldwide, non-exclusive, royalty-free license to display, distribute, and promote content within the platform and for marketing purposes.

13. Account Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms. Upon termination:

  • Unused Coins in your account will be forfeited.
  • Pending creator earnings may be forfeited if termination is due to fraud or policy violations.
  • You may request export of your personal data as described in our Privacy Policy.

14. Disclaimer of Warranties

The Platform is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

15. Limitation of Liability

To the maximum extent permitted by law, Horane Technologies LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from use of the Platform, including but not limited to loss of earnings, loss of data, or loss of virtual currency. Our total liability shall not exceed the amounts paid by you to us in the twelve (12) months preceding the claim.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State in which Horane Technologies LLC is incorporated, without regard to its conflict of law provisions.

17. Changes to Terms

Horane Technologies LLC reserves the right to update these Terms at any time. Material changes will be communicated through the Platform or via email. Continued use of the Platform after changes constitutes acceptance of the updated Terms.
