Welcome to KILKO, operated by Horane Technologies LLC ("Company", "we", "us", "our"). By accessing or using our platform, you agree to these Terms of Service ("Terms").
By creating an account, accessing, or using KILKO in any way, you agree to be bound by these Terms, our Privacy Policy, Community Guidelines, Virtual Coins Policy, Creator Monetization Policy, Reward Conversion Policy, Refund & Dispute Policy, Platform Fee Disclosure, Anti-Abuse & Fraud Policy, and all applicable policies incorporated by reference. If you do not agree to any part of these Terms, you must immediately cease using the platform.
You must be at least 18 years old (or the age of majority in your jurisdiction, whichever is higher) to use KILKO. By using the platform, you represent and warrant that you meet this age requirement and have the legal capacity to enter into a binding agreement. We reserve the right to request age verification at any time and to terminate accounts that do not meet eligibility requirements.
You are solely responsible for maintaining the confidentiality and security of your account credentials. You agree to: (a) provide accurate, current, and complete information during registration; (b) maintain and promptly update your account information; (c) notify us immediately of any unauthorized access or use of your account; (d) accept responsibility for all activities that occur under your account. We are not liable for any loss arising from unauthorized use of your account.
Horane Technologies LLC operates a social entertainment platform. KILKO is NOT a money transmitter, money services business, payment processor, bank, or financial institution of any kind. We do not hold, transfer, or transmit money on behalf of users. Virtual coins are entertainment credits with no monetary value outside the platform. Creator rewards are discretionary platform benefits — they are NOT wages, salary, payments for services, or financial transfers. Payouts to creators represent discretionary platform rewards subject to these Terms and all applicable policies.
Virtual coins are digital entertainment credits with no cash value outside the platform. They are non-refundable, non-transferable between users (except as gifts to creators through designated features), and do not constitute currency, stored value, or financial instruments of any kind. The Company reserves the right to modify coin pricing, availability, and functionality at any time. ALL VIRTUAL COIN PURCHASES ARE FINAL AND NON-REFUNDABLE.
Creator earnings represent discretionary platform rewards, not employment income, wages, contractor payments, or financial transfers. Earnings are calculated as a percentage of gift coin values as configured by the platform. Earnings are subject to a hold period before becoming available for payout. The Company reserves the right to reverse, withhold, or modify earnings associated with fraudulent activity, policy violations, chargebacks, or any conduct we determine violates these Terms.
You may not: (a) manipulate the gifting system or create fraudulent transactions; (b) engage in reciprocal gifting schemes or coordinated manipulation; (c) use bots, scripts, or automated tools to interact with the platform; (d) circumvent platform safeguards, rate limits, or security measures; (e) engage in money laundering or attempt to use the platform for money transmission; (f) impersonate any person or entity; (g) harass, threaten, bully, or intimidate other users; (h) post illegal, harmful, or exploitative content; (i) reverse-engineer, decompile, or disassemble any platform technology; (j) attempt to gain unauthorized access to any platform systems or data; (k) use the platform for any purpose that violates applicable laws or regulations.
You retain ownership of the content you create and post on KILKO ("User Content"). However, by posting, uploading, sharing, or otherwise making User Content available on or through KILKO — including but not limited to posts, comments, messages, images, videos, live streams, audio recordings, and any other material shared in public spaces such as feeds, public networks, public teams, public channels, live rooms, and creator spaces — you hereby grant to Horane Technologies LLC a worldwide, non-exclusive, royalty-free, sublicensable, transferable, irrevocable, and perpetual license to:
This license applies to all User Content shared in public areas of the platform. For content shared in private messages or private spaces, the license is limited to what is necessary to operate, maintain, and improve the platform services. You represent and warrant that you have all rights necessary to grant the above license and that your User Content does not infringe upon the rights of any third party. You acknowledge that Horane Technologies LLC is under no obligation to compensate you for any use of your User Content under this license beyond any creator earnings you may receive through the platform's gifting system.
All platform technology, design, trademarks, trade names, logos, branding elements, software, algorithms, and proprietary content are owned exclusively by Horane Technologies LLC or its licensors and are protected by intellectual property laws. Nothing in these Terms grants you any right, title, or interest in our intellectual property except the limited right to use the platform in accordance with these Terms. You may not use our trademarks, logos, or branding without prior written permission.
KILKO integrates with third-party services including but not limited to Stripe (payments), LiveKit (live streaming), and Ably (real-time communications). Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the acts, omissions, or policies of third-party service providers.
You agree to indemnify, defend, and hold harmless Horane Technologies LLC, its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with: (a) your use of the platform; (b) your User Content; (c) your violation of these Terms; (d) your violation of any rights of another party; (e) any dispute between you and another user.
All disputes, controversies, or claims arising out of or relating to these Terms or your use of the platform shall be resolved through binding individual arbitration in accordance with the rules of the American Arbitration Association, conducted in the state where Horane Technologies LLC is incorporated. YOU EXPRESSLY WAIVE YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT, CLASS-WIDE ARBITRATION, OR ANY OTHER REPRESENTATIVE PROCEEDING. You agree that any arbitration shall be conducted on an individual basis only. The arbitrator's decision shall be final and binding.
These Terms shall be governed by and construed in accordance with the laws of the State in which Horane Technologies LLC is incorporated, without regard to its conflict of laws provisions.
We reserve the right to suspend, restrict, or terminate your account at any time, with or without notice, for any reason, including but not limited to violation of these Terms. Upon termination: (a) all unused coins are immediately forfeited without refund; (b) pending earnings may be withheld at our discretion; (c) your license to use the platform is immediately revoked; (d) provisions that by their nature should survive termination shall survive, including Sections 8, 9, 11, 12, 13, and 14.
We may modify these Terms at any time by posting the revised Terms on the platform. Material changes will be communicated through the platform or via email. Your continued use of the platform after any modification constitutes your acceptance of the modified Terms. If you do not agree to the modified Terms, you must discontinue use of the platform.
If any provision of these Terms is held to be invalid or unenforceable, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, and the remaining provisions shall continue in full force and effect.
These Terms, together with all policies incorporated by reference, constitute the entire agreement between you and Horane Technologies LLC regarding your use of the platform and supersede all prior agreements, understandings, and communications.
